WHO PROCESSES PERSONAL DATA?

In accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter: GDPR),

The joint controllers of personal data in connection with the operation of the website: www.wroclawchessfestival.pl and the KLUB SZACHOWY POLONIA WROCŁAW accounts on social media are:

  • Klub Szachowy Polonia Wrocław Sp. z o.o. (hereinafter also referred to as the “Company”), al. Wiśniowa 47, 53-126 Wrocław, KRS 0000258775,
  • Fundacja Klub Szachowy Polonia Wrocław (hereinafter also referred to as the “Foundation”), al. Wiśniowa 47, 53-126 Wrocław, KRS 0001064287

Each of the Joint Controllers performs and is responsible for:

  • processing data in accordance with Art. 5 of the GDPR;
  • storing documentation regarding joint controllership;
  • fulfilling information obligations towards data subjects;
  • exercising the rights of data subjects;
  • reporting personal data breaches to the supervisory authority and notifying the data subjects of the breach – if required by the GDPR;
  • applying appropriate technical and organizational measures to ensure data security.

The main supervisory authority for joint data processing is the President of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warsaw.

HOW IS PERSONAL DATA COLLECTED?

Personal data is obtained from users of the website or social media profiles who provide data by:

  • publishing a comment under posts we have placed on our profile or on the website or by reacting to content published on our profile,
  • submitting data through contact forms,
  • subscribing to our social media profile (using the “Like” or “Follow” option);
  • accepting Cookies,
  • consenting to receive news (newsletter).

FOR WHAT PURPOSE AND FOR HOW LONG IS PERSONAL DATA PROCESSED?

  • registering a participant for a competition or class, based on consent (Art. 6(1)(a) of the GDPR), until consent is withdrawn,
  • publishing participants' comments, based on consent (Art. 6(1)(a) of the GDPR), until consent is withdrawn or the comment is deleted,
  • sending news, based on consent (Art. 6(1)(a) of the GDPR), until consent is withdrawn,
  • conducting correspondence, pursuing the legitimate interests of the Foundation and the Company based on Art. 6(1)(f) of the GDPR, until the purposes are fulfilled, an objection is raised, or the user changes their cookie settings,
  • conducting analytics and statistics for the purpose of administering the website and social media accounts, pursuing the legitimate interests of the Foundation and the Company based on Art. 6(1)(f) of the GDPR, until the purposes are fulfilled, an objection is raised, or the user changes their cookie settings.

WHO IS PERSONAL DATA TRANSFERRED TO?

The recipients of personal data are:

  • entities providing IT support, hosting, website and social media account management.
  • Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland in connection with the operation of Facebook, as well as Instagram and Messenger, to the extent that personal data is processed for the purpose of providing matching, measurement and analysis services;
  • Google LLC based in the USA and Google Ireland Limited based in Ireland – providers of Google services such as: Google Analytics – a tool for analyzing the Website; Google Ads – a service related to displaying advertisements to Users and Google Tag Manager;
  • ChessManager sp. z o. o., os. Jana III Sobieskiego 26/170, 60-688 Poznań, which runs the portal: chessmanager.com,
  • Polish Chess Federation, 00-514 Warsaw, ul. Marszałkowska 84/92

TRANSFER OF DATA OUTSIDE THE EUROPEAN ECONOMIC AREA

Personal data is not transferred outside the European Economic Area, except for the use of services from the following entities: Google LLC and Meta Platforms Ireland Limited. The transfer of data outside the European Economic Area is based on standard contractual clauses (Art. 46(2) of the GDPR)

JOINT CONTROLLERSHIP – FACEBOOK

The joint controller of personal data is Meta Platforms Ireland Limited (4 Grand Canal Square, Grand Canal Harbour, Dublin 2 Ireland). Joint controllership includes the aggregate analysis of data to display statistics on user activity on the Administrator's Fanpage. The scope of responsibility of Meta Platforms Ireland Ltd for the processing of personal data of users of the Klub Szachowy Polonia Wrocław profile:

  1. having a legal basis for data processing;
  2. ensuring the rights of data subjects are respected;
  3. reporting breaches to the supervisory authority and notifying the data subjects of the incident;
  4. ensuring appropriate technical and organizational measures to ensure data security.

The scope of responsibility of the Company and the Foundation for data processing:

  1. having a legal basis for data processing for statistical purposes;
  2. fulfilling information obligations regarding the processing purposes carried out by the Administrator.

The main supervisory authority for joint data processing is the Irish Data Protection Commission (regardless of the provisions of Art. 55(2) of the GDPR).

WHAT ARE YOUR RIGHTS REGARDING DATA PROCESSING?

The data subject has the right to:

  • access personal data, including confirmation of its processing, receiving a copy of the data and information about data processing,
  • rectify incorrect personal data or complete incomplete data,
  • erase data, provided that there are no exclusions to the exercise of this right,
  • restrict data processing, in cases specified by the GDPR,
  • data portability, including receiving it in a machine-readable format or requesting its transfer to another controller.

The data subject is also entitled to withdraw their consent to data processing at any time, and the withdrawal of consent does not affect the prior data processing.

The data subject may also lodge a complaint with the President of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warsaw.

RIGHT TO OBJECT

The data subject may also object to processing for purposes arising from the legitimate interests of the Law Firm, if this is justified by their particular situation.

An objection to processing for direct marketing purposes (including in connection with information about the performance of the profession) and to profiling carried out for these purposes may be submitted at any time and does not require justification.

PROFILING

Personal data will not be subject to automated decision-making, including profiling within the meaning of Art. 22 of the GDPR.

COOKIE FILES

We store HTTP requests that are downloaded from users visiting the Website (so-called “cookie files”). Cookie files contain the computer's IP, session information, web browser, devices used to display content, activity on the Website or profile. The data is used to administer the Website, determine preferences and for other marketing purposes. You can change the settings and specify the conditions for storing and accessing data so that cookies are blocked or that you are informed that they are being sent to the user's device. When opening the page in the browser for the first time or in a private browser window, the User is asked to consent within the meaning of the Telecommunications Law and the Act on the provision of electronic services to the collection of cookies or to change their collection settings using the toolbar available at the bottom of the page.

If the Website user disables cookies, some elements of our website may not function correctly on their device and they may not have access to all parts of our website. We recommend enabling cookies.

GOOGLE ANALYTICS

The website uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses “cookies” (mentioned above) to enable the website to analyze how users use it. The information generated by the “cookie” about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States.

Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators, and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. Google will not associate your IP address with any other data held by it. The Website user may refuse the use of “cookies” by selecting the appropriate settings in their browser, as mentioned above.

GOOGLE TAG MANAGER

Google Tag Manager is a system for managing tags and codes placed on websites or social media profiles. As part of Google Tag Manager, Google may collect information, for example, about how the service and tags are used and which tags are used. The data is used in accordance with Google's privacy policy. Google's privacy policy is available at: https://policies.google.com/privacy.

FACEBOOK PIXEL

We use the Facebook Pixel, which allows us to display ads on Facebook to its users who have shown interest in materials published by the Company and the Foundation on the Internet or are interested in materials of this kind. The Facebook Pixel allows us to obtain statistics on the use of the Website. To disable the function, you must log in to Facebook.

LINKS TO OTHER WEBSITES AND SOCIAL MEDIA PORTALS

The Website also contains links to other websites. The rules for using websites and protecting the privacy of users of the websites to which the user is redirected via a link are posted on those websites.

The Website contains links to external social media portals (Facebook, Twitter, Instagram, as well as the YouTube channel). After clicking on a given link, the so-called social media plugin is activated, which means that the web browser will connect to the social media portal's server and the user of the website will be redirected to the website of that portal. The portal provider will therefore process data about the User's use of the Administrator's Website. This data will be sent directly from the User's browser to the social media portal's server and stored there. If the User is logged in to a given social media portal, this portal will link the User's visit to the portal with their account on that portal. Therefore, if the User does not want the portal provider to process such data, they should not click on the link.

INFORMATION SECURITY

The Company and the Foundation apply appropriate technical and organizational measures to ensure that the processed personal data is secure, including protecting personal data against unauthorized access, loss or destruction. To ensure the security of personal data, appropriate personal, organizational, technical (IT) and physical safeguards have been implemented.

CHANGES TO THE PRIVACY POLICY

Changes may be made to the Privacy Policy, in particular to adapt it to the requirements of applicable law, by informing about the changes made on the Website.
